The Confidence Concept: The studio operating under the trade name The Confidence Concept, registered in the Netherlands with KvK number 96707038, with its office at Wibautstraat 45, 1091 GH Amsterdam. Hereinafter referred to as "The Confidence Concept", "we", "us" or "our".
Participant: Anyone who has entered into a Participant Agreement with The Confidence Concept.
Participant Agreement: The agreement between The Confidence Concept and a Participant.
Participant Conditions: These general terms and conditions, published on the Website and provided upon request.
Credit: The credit or balance purchased by a Participant to book and/or attend a Class within the specified validity period.
Class: Any individual or group class given by or on behalf of The Confidence Concept at the studio, including Reform, Mat, Mind, Digital and off-peak studio sessions.
Membership: A recurring monthly credit subscription entered into by a Participant with The Confidence Concept.
Personal Data: All data provided by a Participant to The Confidence Concept as stated in the Participant Agreement.
Studio: The studio operated by The Confidence Concept at Wibautstraat 45, 1091 GH Amsterdam.

Article 1 — General
1.1 Each Participant is obligated to familiarise themselves with these Participant Conditions. If there is a Participant Agreement between The Confidence Concept and a Participant, these conditions form an inseparable part of it.
1.2 The rights arising from a Participant Agreement are strictly personal.
1.3 The Confidence Concept reserves the right to limit the total number of registered participants and to change opening hours, class times, the number of classes, and rates.
1.4 The Confidence Concept reserves the right to refuse Participants in cases of misuse of the booking system or studio facilities, or in the event of inappropriate behaviour.
1.5 Wearing clean sportswear is mandatory. Grip socks are required for all Reform and Mat classes. Bare feet and shoes are not permitted in the reformer area.
1.6 The studio is entirely smoke-free.
1.7 The Confidence Concept reserves the right to close the studio on recognised Dutch public holidays or during renovation works.
1.8 Children under 16 years of age are not permitted in the studio or reformer area unless accompanied by a parent or guardian with the explicit consent of studio staff. Leaving children unattended in the studio while a parent attends class is prohibited. Any injury to children due to unauthorised access is at the individual's own risk.
Article 2 — Applicability
2.1 These Participant Conditions apply to all legal relationships between The Confidence Concept and any consumer (Participant) who has purchased Credits and/or participates in a Class or service provided by The Confidence Concept.
2.2 By purchasing Credits, a Membership, or participating in a Class, the Participant agrees to these Participant Conditions.
2.3 All provisions in these Participant Conditions are also drawn up for the benefit of all directors of The Confidence Concept and all persons employed by or contracted by The Confidence Concept.
2.4 Deviations from these Participant Conditions are only valid if expressly agreed upon in writing.
2.5 The Confidence Concept can amend these Participant Conditions at any time. The latest version is always the valid version and is available on the Website. A copy will be provided upon request.
Article 3 — Participant Agreement
3.1 The Participant Agreement between the Participant and The Confidence Concept is established at the moment the Participant (a) completes registration and accepts these conditions, (b) registers online via the Website or booking platform, or (c) attends or participates in a Class.
3.2 The Participant will receive login credentials for the booking platform during or immediately after registration.
3.3 The completed Participant Agreement and these Participant Conditions together constitute the full representation of the rights and obligations of The Confidence Concept and the Participant.
3.4 The Participant ensures that all information required for the performance of the Participant Agreement is provided to The Confidence Concept in a timely and accurate manner.
3.5 Credits have a limited validity period. The individual validity is indicated in the Participant's account. Once Credits have expired or been used, the Participant cannot book a Class until new Credits are purchased.
3.6 In cases of severe injury, prolonged illness, pregnancy, or prolonged stay abroad, the validity of Credits may be suspended with the written consent of The Confidence Concept. The Confidence Concept has the right to request supporting evidence before granting a suspension request.
3.7 Credits expire automatically and will not be automatically extended, except as described in Article 5.2.
3.8 The Participant Agreement is personal. The Participant is not entitled to transfer rights and obligations arising from the Participant Agreement to third parties.
3.9 If a Participant has concluded a Participant Agreement with The Confidence Concept, the Participant is entitled to withdraw within 14 (fourteen) days after signing, without giving any reason, in accordance with Dutch consumer law.
3.10 If the Participant withdraws within the 14-day cooling-off period, The Confidence Concept will refund all payments made, minus any applicable fees for services already used as described in Article 5A.
Article 4 — Services
4.1 The Confidence Concept offers the following services:
Reform — instructor-led reformer Pilates classes at the Amsterdam studio.
Mat — instructor-led, equipment-assisted mat Pilates classes at the Amsterdam studio.
Mind — instructor-led wellness sessions including sound baths, breathwork, cacao ceremonies and meditation at the Amsterdam studio.
Digital — access to 300+ studio-recorded online reformer Pilates classes, available during off-peak hours.
Physical products — grip socks and other studio products sold in-studio and online.
Events and retreats — community events, The Confidence Collective professional development event, and The Confidence Retreat destination retreat.
Studio hire — hire of the studio for private events, wellness sessions and corporate bookings.
4.2 All services are subject to availability. The Confidence Concept reserves the right to change, suspend or discontinue any service at any time.
Article 5 — Prices and Payment
5.1 The current prices for Credits, Credit packs, and Memberships are stated on the Website. The latest prices are always valid and available on the Website. Price increases do not affect already purchased and paid Credits or Memberships.
5.2 Unless otherwise agreed, payments must be made via the online payment system or in-studio. Credits, Memberships, credit packs and retail items must be paid in full in advance.
5.3 Payments made by a Participant will not be refunded unless a valid withdrawal is made in accordance with Article 3.9 and Article 5A.
5.4 The Confidence Concept reserves the right to change its prices and rates. Members will be given at least 30 days' written notice before any price change takes effect.
5.5 If the studio cannot be fully used due to circumstances beyond The Confidence Concept's control, fees payable by the Participant will not be refunded except as required by Dutch law.
5.6 No rights can be derived from promotions or special offers before or after their stated validity period.
5.7 Credits cannot be redeemed for cash and cannot be transferred to another person.
5.8 A Participant's payment will be charged when Credits or a Membership are purchased, not when a class is booked.
5.9 All introductory offers, promotions and discount codes are for one-time use only per individual unless explicitly stated otherwise.
5.10 It is the Participant's responsibility to be aware of any changes in price or expiration of Credits after introductory offers, promotions or discounted credits end.
Retail and merchandise returns
5.11 Unworn, unwashed items with original labels attached may be returned within 30 days of purchase for a refund or studio credit. Proof of purchase must accompany all returns.
5.12 All sale items and accessories, including but not limited to grip socks and water bottles, are final sale unless otherwise stated.
Article 5A — Right of Withdrawal and Pro-Rata Charges
5A.1 Right of withdrawal (cooling-off period). As a consumer, the Participant has the legal right to withdraw from the Participant Agreement within 14 (fourteen) days after concluding the agreement, without giving any reason, in accordance with Article 6:230o of the Dutch Civil Code.
5A.2 Exercising the right of withdrawal. To exercise this right, the Participant must submit a clear written request to mangka@theconfidenceconcept.com stating that they wish to withdraw from the Participant Agreement.
5A.3 Use of services during the cooling-off period. If the Participant makes use of The Confidence Concept's services during the 14-day withdrawal period, The Confidence Concept is entitled to charge a reasonable pro-rata fee for the part of the service delivered prior to withdrawal. Use of services includes entering the studio, attending a Class, booking a Class, and/or using Credits.
5A.4 Calculation of pro-rata fee. The pro-rata fee is calculated based on the applicable Membership fee and/or the value of Credits used, and/or the number of days the Membership was active prior to withdrawal.
5A.5 Promotional offers. If the Participant signed up using an introductory offer or promotion, the right of withdrawal still applies. However, if services have been used during the withdrawal period, the pro-rata fee will be calculated based on the regular applicable rate, not the promotional rate.
5A.6 Refund process. If the Participant withdraws within the 14-day period, The Confidence Concept will refund the amount paid minus any applicable pro-rata fee within 14 (fourteen) days of confirming receipt of the withdrawal request.
Article 6 — Bookings, Cancellation and No-Show Policy
6.1 Classes must be booked in advance through the booking platform (Momence) or Website. Without a confirmed booking, the Participant has no right to participate in a Class.
6.2 Credits and credit packs have an expiration date as stated on the pricing page and in the Participant's account.
6.3 The Confidence Concept accepts payment via the methods available on its booking platform. We do not store payment card details — all payment processing is handled by our third-party payment provider.
6.4 If a payment fails, The Confidence Concept will make reasonable efforts to contact the Participant. If payment remains outstanding, access to the booking platform and studio may be suspended. The Participant shall be liable for any external costs, including collection costs, incurred in recovering outstanding payments.
6.5 You are responsible for ensuring the class, date and time you book are correct. We are unable to offer refunds or credit transfers for bookings made in error.
Cancellation policy
6.6 Free cancellation: You may cancel your booked class free of charge up to 12 hours before the scheduled start time. The Credit will be returned to your account.
6.7 Late cancellation fee: If you cancel within 12 hours of the scheduled start time, a late cancellation fee of €7.50 will be charged to your account or payment method on file.
6.8 No-show fee: If you do not attend a booked class without cancelling, a no-show fee of €15.00 will be charged to your account or payment method on file.
6.9 How to cancel: Classes must be cancelled through your account on the booking platform or by emailing info@theconfidenceconcept.com. Cancellation requests sent via Instagram, WhatsApp or other social channels cannot be guaranteed to be processed in time and may not be accepted.
Exceptional circumstances
6.10 If you believe a cancellation fee has been applied unfairly due to exceptional circumstances, please contact us at info@theconfidenceconcept.com within 48 hours of the class. We will review requests on a case-by-case basis and reserve the right to make a final decision.
Arrival and punctuality
6.11 Please arrive at least 10 minutes before your class. Late arrivals may not be admitted to class at the instructor's discretion, and the Credit or session fee will not be refunded.
6.12 First-time participants: For safety reasons, a brief introduction to the class is given 5 minutes before it begins. First-timers must arrive no less than 10 minutes before the start of the class.
Schedule and class changes
6.13 The Confidence Concept reserves the right to adjust the class schedule and/or locations at any time. The latest schedules are always available on the Website and booking platform.
6.14 The Confidence Concept reserves the right to cancel a Class if there is insufficient interest. In that case, the Credit charged to the Participant will be returned to their account.
6.15 Extraordinary circumstances constituting force majeure release The Confidence Concept from its obligations. In the event of continuing force majeure, The Confidence Concept is released from its obligation to fulfil the agreement.
6.16 If a Participant causes inconvenience or nuisance that disrupts the proper execution of a Class, The Confidence Concept may exclude them from the Class. All resulting costs will be borne by the Participant.
6.17 If a Participant is on the waitlist, they will receive a notification if they are enrolled in the class. If no enrolment confirmation is received, the Participant has not secured a spot.
Article 7 — Credits and Memberships
7.1 Credit entitles the Participant to participate in classes , subject to the Credit value assigned to each class type.
7.2 Credits are strictly personal and may not be transferred, gifted or sold to another person.
Credit expiry
7.3 Credits purchased as one-off credit packs are valid as follows:
Packs under 50 credits are valid for 3 months from the date of purchase.
Packs of 50 credits and 100 credits are valid for 12 months from the date of purchase.
7.4 Credits assigned to a monthly Membership cycle are valid within that monthly cycle. Unused credits roll over for one additional month. Credits that remain unused after the rollover month expire automatically and cannot be reinstated.
Memberships
7.5 The Confidence Concept offers monthly recurring credit Memberships. By purchasing a Membership, the Participant authorises The Confidence Concept to charge the Membership fee to the chosen payment method on a recurring monthly basis.
7.6 All Memberships are subject to a minimum commitment period of 3 (three) months from the date of the first payment. The Participant may not cancel their Membership during this initial period except in cases of serious medical condition or other exceptional circumstances at the discretion of The Confidence Concept.
7.7 After the minimum three-month commitment period, the Membership continues on a rolling monthly basis. The Member may cancel at any time with 1 (one) calendar month's written notice sent to info@theconfidenceconcept.com.
7.8 Cancellation takes effect at the end of the notice period. The Member retains access to Membership Credits until the final day of the last paid month.
7.9 Membership cancellations cannot be processed via social media, WhatsApp or verbal request. Written email notice is required.
Membership pauses
7.10 Membership pauses may be available at the discretion of The Confidence Concept. Please contact us directly at info@theconfidenceconcept.com to discuss your circumstances. The Membership cannot be paused retroactively.
Membership fees and failed payments
7.11 The Membership fee must be paid in advance each month via the payment method on file. The Confidence Concept reserves the right to collect overdue payments.
7.12 If a payment is rejected, The Confidence Concept will contact the Member in writing to request settlement. Should the payment remain incomplete, two (2) official written warnings will be issued, followed by referral to an external collection agency. The Member will also be liable for any administrative and extrajudicial collection costs incurred.
7.13 Access to Credits and studio facilities may be suspended until outstanding payments are resolved.
7.14 The Membership is strictly personal and may only be transferred with the prior written permission of The Confidence Concept.
7.15 The Confidence Concept reserves the right to request identification from Members at any point while on the premises.
Article 8 — Required Equipment
8.1 Grip socks are mandatory for all Reform classes. Bare feet and shoes are not permitted in the reformer area or during Mat classes.
8.2 The Confidence Concept reserves the right to refuse entry to a Class if a Participant does not have the required grip socks. The Participant will not be refunded for the class in such circumstances.
8.3 Grip socks can be purchased at the studio reception or through the online shop.
Article 9 — Studio Rules
9.1 To maintain a safe, welcoming and respectful environment for all Participants, the following rules apply at all times:
Grip socks must be worn for all Reform classes.
Please arrive at least 10 minutes before your class. Late entry is at the instructor's discretion.
Mobile phones must be switched to silent during classes. Phone use during class is not permitted.
Please treat all instructors, staff and fellow Participants with courtesy and respect.
Food is not permitted in the studio. Sealed water bottles are permitted.
Personal belongings are left at your own risk. The Confidence Concept is not responsible for lost or stolen items.
The studio is smoke-free. Smoking is not permitted anywhere on the premises.
Children under 16 are not permitted in the studio or reformer area without prior consent.
9.2 The Confidence Concept reserves the right to refuse entry or remove any Participant from the studio whose behaviour is disruptive, disrespectful or unsafe, without refund.
Article 10 — Physical Products
10.1 Physical products, including grip socks, are available for purchase in-studio and through the online shop. Prices are as listed at the time of purchase.
10.2 Online orders — delivery. Online orders will be dispatched within the timeframe stated at checkout. Delivery times are estimates and cannot be guaranteed. The Confidence Concept is not responsible for delays caused by third-party couriers or circumstances outside its control.
10.3 Online returns. Under Dutch and EU consumer law, the Participant has the right to withdraw from an online purchase within 14 days of receiving the order. Products must be returned unused, unworn and in their original packaging. Return shipping costs are the Participant's responsibility unless the product is faulty or incorrect. Contact info@theconfidenceconcept.com to initiate a return. Refunds will be processed to the original payment method within 14 days of The Confidence Concept receiving the returned goods.
10.4 In-studio purchases. Products purchased in-studio may be exchanged if returned unused, unworn and with proof of purchase. Cash refunds are not offered on in-studio purchases unless the product is faulty.
10.5 Faulty products. If a faulty or incorrect product is received, please contact info@theconfidenceconcept.com within 14 days of receipt. A replacement or full refund will be arranged at no cost to the Participant.
Article 11 — Events, Retreats and Studio Hire
11.1 The Confidence Concept organises community events, professional development events (The Confidence Collective) and destination retreats (The Confidence Retreat). Specific terms for each event — including booking, payment, cancellation and refund conditions — will be provided at the time of booking and form part of these Participant Conditions.
11.2 In the event of cancellation by The Confidence Concept, participants will receive a full refund of amounts paid. The Confidence Concept is not responsible for any travel, accommodation or other costs incurred by participants in connection with an event or retreat.
11.3 Studio hire enquiries are subject to a separate hire agreement provided upon request. Studio hire bookings require a deposit and are subject to cancellation and damage policies set out in the hire agreement.
Article 12 — Risk and Liability
12.1 Participation in Pilates, wellness and fitness activities at The Confidence Concept studio is entirely at the Participant's own risk and responsibility.
12.2 The Participant is obliged to inform The Confidence Concept and the instructor, before, during and after any class, of their physical condition, including injuries, illnesses, pregnancy and any other relevant physical conditions. The Participant is solely responsible for providing this information.
12.3 The Confidence Concept and its employees are not liable for material or immaterial damage resulting from an accident or injury to the Participant or third parties, except where liability cannot be excluded under Dutch law.
12.4 The Confidence Concept and its employees accept no liability for damage, loss or theft of the Participant's or a third party's property.
12.5 The Participant is liable for damage caused to The Confidence Concept's property resulting from negligence or fault of the Participant.
12.6 Participants are urged not to bring valuables to the studio. The Confidence Concept shall not be liable for loss, theft or damage to personal property, including items left in changing areas or anywhere else on the premises.
Article 13 — Digital Access
13.1 Access to online classes and off-peak studio sessions is subject to the terms of the specific Membership or Credit pack.
13.2 The Confidence Concept reserves the right to change, update or remove digital content at any time. Access to digital content is provided on an as-available basis and uninterrupted access is not guaranteed.
Article 14 — Personal Data and Privacy
14.1 Each Participant is aware that they provide certain personal data to The Confidence Concept, including name, date of birth, address and email address. Personal data is treated as strictly confidential and used solely for the administration and provision of The Confidence Concept's services.
14.2 By accepting these Participant Conditions, the Participant gives The Confidence Concept permission to process their personal data in accordance with the Privacy Policy available at www.theconfidenceconcept.com/privacy and in compliance with the General Data Protection Regulation (GDPR / AVG). The Confidence Concept will destroy all Participant data upon written request.
14.3 The Confidence Concept may take photos or videos in the studio for use on social media or the Website. By accepting these conditions, the Participant acknowledges this. If a Participant does not wish to appear in such content, they must notify The Confidence Concept in writing at info@theconfidenceconcept.com.
14.4 The Confidence Concept does not sell personal data to third parties. Data is shared with third-party service providers only where necessary to deliver services, and only under appropriate data processing agreements.
Article 15 — Complaints
15.1 A Participant must report a complaint regarding any performance of The Confidence Concept as soon as possible after the defect or issue has been observed, and no later than 14 (fourteen) days after the Participant becomes aware of it. Complaints must be submitted by email to info@theconfidenceconcept.com with a clear description of the complaint and any supporting evidence.
15.2 The Confidence Concept will respond to complaints as soon as possible, and no later than 10 (ten) business days from receipt. If more time is required, the Participant will be notified promptly.
15.3 If a complaint cannot be resolved through mutual agreement, the Participant may refer the matter to the Dutch consumer authority (Autoriteit Consument & Markt, www.acm.nl) or another competent dispute resolution body.
Article 16 — Website and Booking Platform
16.1 Information provided on the Website is intended for general informational purposes. The Confidence Concept exercises care in maintaining its Website but cannot guarantee that all information is complete, up-to-date or accurate at all times.
16.2 The Confidence Concept is not liable for any direct or indirect damage arising from use of the Website, except in cases of intent or gross negligence.
16.3 The Website and all its content, including text, images, video content, class recordings and branding, are protected by copyright, trademark and other intellectual property rights belonging to The Confidence Concept or its licensors. Nothing may be reproduced or distributed without prior written permission.
16.4 The Confidence Concept is not responsible for the content of third-party websites linked from the Website.
Article 17 — Applicable Law and Competent Court
17.1 These Participant Conditions are governed by the laws of the Netherlands.
17.2 Deviations from these Participant Conditions are only valid if confirmed in writing by The Confidence Concept.
17.3 If any provision in these Participant Conditions is declared void or nullified, the remaining provisions shall continue in full effect. The Confidence Concept and the Participant shall enter into consultation to agree on replacement provisions consistent with the original purpose.
17.4 All disputes between the Participant and The Confidence Concept arising from or in connection with the Participant Agreement shall be exclusively settled by the competent court in the district of Amsterdam, without prejudice to the Participant's rights as a consumer under applicable EU law.
